Within the scope of processing activities carried out through the service, the client acts as data controller for the information it decides to transmit or have transmitted to the service. GestionEstate acts solely as a technical service provider and processor, within the limits of the service provided.
This document sets out the framework under which GestionEstate processes, on behalf of the client, information transmitted to the service.
Any information transmitted to the service constitutes an explicit processing instruction. Processing is strictly limited to the information effectively transmitted and to the technical operations required for service operation, structuring, exploitation and security.
Processed information may include identification data, contact details, declarative professional information and any other data transmitted on the client’s initiative within the use of the solution. Such information is not substantively verified by GestionEstate.
GestionEstate does not determine the purposes pursued by the client, the upstream collection methods or the client’s internal organization. GestionEstate does not manage the client’s internal compliance strategy or regulatory obligations on its behalf.
The client remains solely responsible for the lawfulness of the transmitted information, the applicable legal basis, information notices, retention choices and the general compliance with its own regulatory obligations, including in the area of data protection.
GestionEstate implements technical and organizational measures aligned with professional standards, including communication encryption, secure secret management according to the standards of the cloud providers used, logical isolation of environments, logging and auditability mechanisms, and network protection controls.
GestionEstate undertakes not to sell, transfer or commercially exploit the information processed on behalf of the client outside the strict needs of execution, maintenance, security and service improvement.
GestionEstate shall not be liable for the quality, accuracy, completeness, compliance or collection conditions of transmitted information. Any responsibility relating to upstream data remains exclusively with the client.
This agreement applies within the limits of the service effectively provided by GestionEstate and may be supplemented or replaced by a specific contractual version in the context of a formal commercial relationship.
